The High Court has dismissed a case in which Jordan Ssebuliba 40, sought court to compel his dad, tycoon Mogan Kiwanuka 69, undergo tests to determine the level of his capacity to make sound decisions.
In his ruling, Justice Musa Ssekaana notes that having memory lapses once in a while doesn’t mean one has a problem with their mental health but it is rather caused by a number of factors including old age.
Ssekaana told court that when he summoned Ssebuliba’s lawyers together with Kiwanuka and his lawyers to his chambers, and engaged him on a number of things, he was very calm and his words were well coordinated.
He found no problem with his decision making capacity and thus ruled there is need for the tycoon to undergo a test. He dismissed the case.
Ssebuliba had gone to the High Court seeking an order to have his dad undergo tests, claiming his dad was suffering from the Alzheimer’s disease and, therefore, incapable of running his empire that includes over 50 properties in the prime areas of Kampala.
